Changes in the civil aviation regulatory regime relating to Air Services Permits (“ASP”)
Section 102(1) of the Malaysian Aviation Commission Act 2015 (“Act”) provides that all approvals pertaining to matters under the Act, pending before the Minister of Transport (“MOT”) or the Director General of Department of Civil Aviation (“DCA”) under the Civil Aviation Act 1969 (“CAA”), shall be dealt with by MAVCOM. Section 102(2) of the Act states that all documents pertaining to matters under this Act lodged with the MOT or the DCA under the CAA before 1 March 2016 shall be lodged with MAVCOM.
For those who has been granted with provisional approvals (“Kelulusan Berprinsip”) by MOT prior to 1 March 2016, it is advised that they submit the following to MAVCOM, as soon as possible:
(i) all documents previously lodged with MOT in relation to the ASP application; and
(ii) information / documents as per the ASP application checklist provided (also available on the MAVCOM website).
