Abuse of dominant position
Abuse of a dominant position in any aviation service market is prohibited under Malaysian law. Market share, while important, is not the sole determinant on whether an enterprise occupies a dominant position or not.
The prohibition against any abuse of a dominant position does not include actions which have reasonable commercial justification or represents a reasonable commercial response to the market entry or market conduct of a competitor.
MAVCOM has the authority to investigate any suspected abuse of a dominant position in any aviation service market.
